1. Introduction

Welcome to HookedOrtho. These Terms of Service ("Terms") govern your use of the HookedOrtho website, services, and products (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

HookedOrtho is a platform dedicated to providing motivation and self-realization services in Romania. We offer workshops, coaching, and resources to help individuals achieve their personal and professional goals.

2. Account Registration

To access certain features of the Services, you may need to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

We reserve the right to suspend or terminate your account if any information provided during the registration process or thereafter proves to be inaccurate, not current, or incomplete.

3. User Conduct

You agree to use the Services only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Services in any way that violates any applicable local, state, national, or international law or regulation
  • Impersonate or attempt to impersonate HookedOrtho, a HookedOrtho employee, another user, or any other person or entity
  • Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Services
  • Use the Services in any manner that could disable, overburden, damage, or impair the site or interfere with any other party's use of the Services
  • Use any robot, spider, or other automatic device, process, or means to access the Services for any purpose
  • Use the Services to transmit or distribute any harmful or malicious code

4. Payment Terms

Certain Services may require payment. By purchasing any of our paid Services, you agree to pay all fees and charges associated with your account on a timely basis and in the currency listed. All payments are non-refundable except as expressly set forth in our Refund Policy.

We use third-party payment processors to bill you through a payment account linked to your account. The processing of payments will be subject to the terms, conditions, and privacy policies of the payment processor in addition to these Terms.

We reserve the right to change our prices at any time. If we change pricing for a service you've already purchased, we will notify you before the change takes effect.

5. Intellectual Property Rights

The Services and their entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by HookedOrtho, its licensors, or other providers of such material and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Services strictly in accordance with these Terms. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Services, except as generally and ordinarily permitted through the Services according to these Terms.

6. User Content

Our Services may allow you to post, submit, publish, display, or transmit content ("User Content"). By providing any User Content on the Services, you grant us and our affiliates and service providers, and each of their and our respective licensees, successors, and assigns the right to use, reproduce, modify, perform, display, distribute, and otherwise disclose to third parties any such material.

You represent and warrant that:

  • You own or control all rights in and to the User Content and have the right to grant the license granted above
  • All of your User Content does and will comply with these Terms

We are not responsible or liable to any third party for the content or accuracy of any User Content posted by you or any other user of the Services.

By using the Services, you consent to the collection, use, and disclosure of your information as set forth in our Privacy Policy.

8. Limitation of Liability

IN NO EVENT WILL HOOKEDORTHO, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SERVICES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for certain damages. Accordingly, some of the above limitations may not apply to you.

9. Indemnification

You agree to defend, indemnify, and hold harmless HookedOrtho, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Services.

10. Termination

We may terminate or suspend your account and bar access to the Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

11. Governing Law

These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation shall be governed by and construed in accordance with the laws of Romania, without giving effect to any choice or conflict of law provision or rule.

12. Changes to Terms

We may revise and update these Terms from time to time in our sole discretion. All changes are effective immediately when we post them, and apply to all access to and use of the Services thereafter. Your continued use of the Services following the posting of revised Terms means that you accept and agree to the changes.
